By using the KvPOS System (“the App”), you agree to the following Terms of Service. Please read these terms carefully before using the App.
The App is designed for internal use by authorized staff of Kaimosi Vert Hotel and Eutopian Tech. You must not use the App for unlawful, harmful, or unauthorized purposes, and must only access data and features permitted by your assigned role.
You are responsible for maintaining the confidentiality of your login credentials. On shared devices (e.g. Windows point-of-sale stations), you are responsible for correctly identifying yourself as the active operator before performing any action, as all actions are recorded under the selected operator’s name for audit purposes. We reserve the right to suspend or terminate accounts found in violation of these terms.
The App may require you to submit identity verification information, including a national ID or passport number, KRA PIN, photos of your ID document, and a selfie photograph, for HR and compliance purposes. You confirm that any information you submit is accurate and belongs to you.
The App includes an internal messaging feature visible to other authorized staff. When using it, you agree not to post content that is unlawful, harassing, abusive, or that discloses confidential business information beyond what is appropriate for internal use. Messages you post remain associated with your username and are retained as part of the shared conversation history, including after your account is deleted (see our Privacy Policy).
If your role has access to the in-app AI assistant, you acknowledge that your questions, any images you attach, and relevant business data needed to answer your question are sent to a third-party AI service provider to generate a response, as described in our Privacy Policy. Do not submit information through the AI assistant that you are not authorized to disclose.
The App enables customer payments via M-Pesa. Payment processing is performed by Safaricom; we are not responsible for the availability, accuracy, or performance of Safaricom’s payment network. You are responsible for verifying payment confirmations before completing a transaction.
The App collects account information, identity verification data, operational and financial records, and other information as described in our Privacy Policy. All data is handled according to that Privacy Policy.
Orders, financial totals, and related audit records created through your use of the App are retained by the Business for accounting, tax, and legal-audit purposes, and are not deleted when your account is deleted.
All rights, titles, and interests in the App (including software, content, and trademarks) remain the property of Eutopian Tech. You may not reproduce, modify, or distribute any part of the App without prior written permission.
We are not responsible for any loss of data, revenue, or business opportunity resulting from the use or inability to use the App, including any failure, delay, or error in third-party services the App relies on (including Firebase, Safaricom M-Pesa, and our AI service provider). The App is provided “as is” without warranties of any kind, either express or implied.
We may modify these Terms at any time. Continued use of the App after such changes constitutes acceptance of the revised Terms.
